The book contains twelve essays by Stephen Holmes, Frances M. Kamm, Mária Ludassy, Steven Lukes, Gyorgy Markus, András Sajó, Gáspár Miklós Tamás, Andrew Arato, Timothy Garton Ash, Béla Greskovits, Will Kymlicka, and Aleksander Smolar. The studies explore a wide scope of subjects that belong to disciplines ranging from moral philosophy, through theory of human rights, democratic transition, constitutionalism, to political economy. The common denominator of the studies collected is their reference to the scholarly output of János Kis, in honor of (...) his sixtieth birthday. János Kis is a distinguished political philosopher who, after many years spent as a dissident under the Communist regime, emerged as an important political figure in Hungary's transition to democracy. This article analyzes how five leading Hungarian postdissident liberal thinkers conceptually constructed their view of liberalism in the early years of postcommunism. Studying Beszélő, the most signi cant liberal journal during the early years of representative democracy, it shows how they did so through references to political “threats” and the idea of a “liberal minimum” (János Kis), local liberal and democratic traditions and “progressive patriotism” (Miklós Szabó), the ongoing “liberal-conservative revolution” and the creation of a “new political community” (Gáspár Miklós (...) Tamás), antipolitics and “expertise” (György Konrád), and the “complete catalog of human rights” and the agenda of “modernization” (István Eörsi), respectively. Next to its conceptual analysis of heavily influential individual thinkers, the article discusses the ambition of postdissident Hungarian liberals to harmonize liberal and democratic tenets. Last but not least, it elaborates on the left-wing origins of many of their central concepts that, as suggested here, ultimately hindered liberalism's assumption of a central position in the new political system. Speaking of “delight of knowledge” al-Māwardī- explains the meaning of knowledge in a sense which is alien to the philosophical tradition, but well known in the ancient Greek rhetoric. Some signs indicate that the Arabic adab-literature is in a certain respect heir to the Greek rhetoric. The presence of some elements of philosophy in al-Māwardī’s writings can be explained by the fact that the traditional rhetoric formation relied on a basic knowledge of philosophy too. This kind of the popular version (...) of philosophy has been conveyed to al-Māwardī, and through him to the Arab readers. One has to take into account the ancient rhetoric and the adab-literature as an alternative channels through which Greek philosophy has been transmitted to the Islam. (shrink)

We study behind-the-scenes investor activism promoting environmental, social, and governance improvements by means of a proprietary dataset of a large international, socially responsible activist fund. We examine the activist’s target selection, forms of engagement, impact on ESG performance, drivers of success, and effects on the targets’ operations and value creation. Target firms are typically large and visible, perform well, and have high liquidity and low ESG performance. Engagement induces ESG rating adjustments: firms with poor ex ante ESG ratings experience a (...) ratings increase after complying with the activist’s demands, whereas firms with high ex ante ESG ratings experience a ratings decrease following the revelation of their ESG problems. Activism that is focused on environmental and social issues is more likely to succeed if targets are ESG-sensitive. Successful engagements boost targets’ sales. Risk-adjusted excess stock returns of successful engagements outperform those of unsuccessful engagements by 2.7%. Results are especially strong for firms with low ex ante ESG scores. Specifically, targeted firms in the lowest ex ante ESG quartile outperform matched peers by 7.5% in the year after the end of the engagement. Our results thus suggest that the activism regarding corporate social responsibility generally improves ESG practices and corporate sales and is profitable to the activist. Taken together, we provide direct evidence that ethical investing and strong financial performance, both from the activist’s and the targeted firm’s perspective, can go hand-in-hand together. Most philosophers believe that a person can have an obligation only insofar as she is able to fulfil it, a principle generally referred to as “Ought Implies Can”. Arguably, this principle reflects something basic about the ordinary concept of obligation. However, in a paper published recently in this journal, Wesley Buckwalter and John Turri presented evidence for the conclusion that ordinary people in fact reject that principle. With a series of studies, they claimed to have demonstrated that, in people’s judgements, (...) obligations persist irrespective of whether those who hold them have the ability to fulfil them. We argue in this paper that due to some problems in their design, Buckwalter & Turri’s conclusions may not be war- ranted. We present the results of a series of studies demonstrating the problems with their design and showing that, with an improved design, people judge that obligation depends on ability after all. This paper argues for a reappraisal of extant scholarship on delegation in the domain of financial regulation. Through an examination of Japan's experience with financial regulation between 1992 and 2003, it is demonstrated that crisis-induced institutional development entails a shift toward a more flexible, trustee-type bureaucratic structure. While the logic presented in this paper is far from a universally applicable theory of institutional change, it calls into question the relevance of more conventional approaches to the origins of delegation of authority, (...) notably the approach that uses unified and divided government as a key variable. A renewed emphasis on the role of extra-political sources of transfers of authority inside the executive, and also between the legislature and the executive, therefore, is in order. (shrink)

In this paper, I critically analyze Andrea Sangiovanni’s approach to international justice in the EU that he labels Reciprocity-based Internationalism (RBI). I aim to show that the type of reciprocity RBI operates with is not a morally attractive ground for distributive justice because it cannot cope with the case of member states’ inability to reciprocate the production of collective goods at the EU level. I illustrate this with the case of disability. I contrast RBI’s understanding of reciprocity with Christie Hartley’s (...) ‘relationship model’. I argue that the relationship model of reciprocity should characterize the EU, whose two core normative features are fraternity and equal status. The advantage of the relationship model is that it calls for a stronger type of solidarity than RBI does. That not only entails the willingness to support those worse-off members that cannot productively reciprocate other member states’ efforts at the EU level but also calls for a higher redistribution rate within the EU. In the paper, I make three comparisons between RBI’s ‘productive reciprocity’ and the relationship model. The first concerns non-EU-integration-related disadvantages; the second concerns membership cases, such as accession to federations and supranational unions, while the third comparison examines EU-integration-related disadvantages. I argue that the relationship model is a better alternative to RBI in both integration-related and non-integration-related disadvantages. Also, the relationship model can justify accession cases where previous historical ties are relevant, which are outside of the purview of RBI. (shrink)

Gyorgy Tamas works in the philosophy of logic, that difficult interdisciplin ary region wherein the notion of categories is both basic and subtle. To understand ways of thinking, to understand patterns of whatever is real, to recognize what is possible and to reject the nonsensical and the impossible is to comprehend the categories. This was a in thought and in fact, recurring motive of European thought from the earliest self-aware beginnings, and Tamas knows that history well, as his (...) critical respect demonstrates. Ancient, medieval, and modern thinkers appear in this book, set forth in their own words; and likewise we see that Tamas has built upon the historians and commentators, upon the pioneering historical investigation of the categories by Trendelenburg a century ago and by Bochenski in our days. Tamas has two principal goals here: to investigate the logic, which is to say the structure and the relations, of the philosophical categories; and to set forth the logic of thought which may then be based upon the critically established system of categories obtained by that investigation. Ancillary but of striking value is his style of historical relevance which enables the reader to engage in a discussion that is both analytically sharp and developmentally insightful. Furthermore, Tamas draws upon his contem porary colleagues with similar critical respect: Lukasiewicz, Quine, Patzig, Menne, Tavanets and others. (shrink)

John von Neumann (1903-1957) was undoubtedly one of the scientific geniuses of the 20th century. The main fields to which he contributed include various disciplines of pure and applied mathematics, mathematical and theoretical physics, logic, theoretical computer science, and computer architecture. Von Neumann was also actively involved in politics and science management and he had a major impact on US government decisions during, and especially after, the Second World War. There exist several popular books on his personality and various collections (...) focusing on his achievements in mathematics, computer science, and economy. Strangely enough, to date no detailed appraisal of his seminal contributions to the mathematical foundations of quantum physics has appeared. Von Neumann's theory of measurement and his critique of hidden variables became the touchstone of most debates in the foundations of quantum mechanics. Today, his name also figures most prominently in the mathematically rigorous branches of contemporary quantum mechanics of large systems and quantum field theory. And finally - as one of his last lectures, published in this volume for the first time, shows - he considered the relation of quantum logic and quantum mechanical probability as his most important problem for the second half of the twentieth century. The present volume embraces both historical and systematic analyses of his methodology of mathematical physics, and of the various aspects of his work in the foundations of quantum physics, such as theory of measurement, quantum logic, and quantum mechanical entropy. The volume is rounded off by previously unpublished letters and lectures documenting von Neumann's thinking about quantum theory after his 1932 Mathematical Foundations of Quantum Mechanics. The general part of the Yearbook contains papers emerging from the Institute's annual lecture series and reviews of important publications of philosophy of science and its history. (shrink)

Moti Mizrahi provides experimental evidence according to which subjects judge that a person ought to ? even when she cannot ?. He takes his results to constitute a falsification of the alleged intuitiveness of the ‘Ought Implies Can’ principle. We point out that in the light of the fact that (a) ‘ought’ is multiply ambiguous, that (b) only a restricted set of readings of ‘ought’ will be relevant to the principle, and that (c) he did not instruct his subjects appropriately (...) – or otherwise ensure that in their ‘ought’ judgements they applied the relevant concept(s) – Mizrahi’s conclusions appear premature. We suggest two ways in which the experimental design could be adjusted or supplemented. First, Mizrahi could instruct (or prime) subjects to read the ‘ought’ question in a particular way. Second, he could complement his experiment by asking follow-up questions aimed at uncovering the implications for blame of subjects’ judgements. Once these adjustments are applied, an experiment with a similar outcome would be more significant. (shrink)

Artificial Culture" is an examination of the articulation, construction, and representation of "the artificial" in contemporary popular cultural texts, especially science fiction films and novels. The book argues that today we live in an artificial culture due to the deep and inextricable relationship between people, our bodies, and technology at large. While the artificial is often imagined as outside of the natural order and thus also beyond the realm of humanity, paradoxically, artificial concepts are simultaneously produced and constructed by human (...) ideas and labor. The artificial can thus act as a boundary point against which we as a culture can measure what it means to be human. Science fiction feature films and novels, and other related media, frequently and provocatively deploy ideas of the artificial in ways which the lines between people, our bodies, spaces and culture more broadly blur and, at times, dissolve. Building on the rich foundational work on the figures of the cyborg and posthuman, this book situates the artificial in similar terms, but from a nevertheless distinctly different viewpoint. After examining ideas of the artificial as deployed in film, novels and other digital contexts, this study concludes that we are now part of an artificial culture entailing a matrix which, rather than separating minds and bodies, or humanity and the digital, reinforces the symbiotic connection between identities, bodies, and technologies. Un modello antioggettivistico di filosofare senza perdere di vista né l'esercizio del dubbio né la dimensione della fede. Attraverso l' interpretazione kierkegaardiane di C. Fabro si è giunti all'esposizione e ai lineamenti descrittivi fondamentali della nozione del singolo. Il singolo viene presentato dallo stesso Kierkegaard (...) come la mia categoria. Sta di fatto che si può intendere l'intera produzione kierkegaardiana come un pensare soggettivamente il singolo. Pensiero etico carico di conseguenze pratiche, giacchè il danese non pretendeva fondare una scuola filosofica ma soltanto rendere attenti, svegliare le coscienze. (shrink)

This article shows that the various regimes of “real socialism” uniformly failed to transcend the horizon of capitalism. They have remained class societies based on wage labour, commodity production, a money economy and welfare systems fed by redistribution. At the same time, they present peculiar features that are different from other versions of “state capitalism.” Traditional elites were annihilated, private property of capital in the hands of individuals or autonomous groups was prohibited, and the advantages accruing to leading positions were (...) not inherited, although equality in income was very modest. The main political invention of “real socialism” was the Party, a unique institution unlike any other, grounded in theory, but an institution of the state, over the executive, which had unprecedented powers of mobilisation and cultural influence. It had to be intellectual in character, as the system was steered through the Plan which was, in the final analysis, a text. The changes of 1989 took place partly mediated by the Party, partly against its rule. The successor regimes are conspicuously political owing to the nature of the adversary. (shrink)

Wish-fulfilment as a singular means of satisfying ineluctable desire is a pivotal concept in classical psychoanalysis. Freud argued that it was the thread that united dreams, daydreams, phantasy, omnipotent thinking, neurotic and some psychotic symptoms such as hallucinations and delusions, art, myth, and religious illusions. The concept's theoretical exploration has been largely neglected within psychoanalysis since, but contemporary philosophers have recognised it as providing an explanatory model for much of the kind of irrational behaviour so problematic for psychiatry, social psychology (...) and the philosophy of mind. Although critically neglected in contemporary psychological and psychoanalytic thought, the concept remains clinically fundamental, under different labels: it encompasses the processes of omnipotent phantasy, symbolic or substitutive satisfaction, actualisation in transference and acting out, symptom formation and defenses such as projective identification. Wish-fulfilment can be shown to be a specifically psychoanalytic compartment of a common-sense psychological theory of action that illuminates not just clinical material but also the paradoxes of irrationality – such as weakness of will and self-deception – that preoccupy philosophers. The first half of this book develops a comprehensive and novel theory of wish-fulfilment, explores its radical implications for the structure of mind, and locates it against the backdrop of both contemporary psychoanalytic and philosophical thought. In the second half, the book applies the theory to illuminate important features of self-deception and delusion, religion, insanity defences, creative writing and the exclusion of mind and intention in the biological drift of modern psychiatry. The book will be essential to philosophers of mind, psychoanalysts, psychiatrists, psychologists, social theorists, and students in these disciplines; as well as readers interested in understanding how the mind works in mental illness, self-deception, religion, and creative writing. In this paper, we defend the main claims of our earlier paper “Mental Fictionalism as an Undermotivated Theory” (in The Monist) from Gábor Bács’s criticism, which appeared in his “Mental fictionalism and epiphenomenal qualia” (in Dialectica). In our earlier paper, we tried to show that mental fictionalism is an undermotivated the-ory, so there is no good reason to give up the realist approach to the folk psychological discourse. The core of Bács’s criticism consists in that our argumentation rests on an (...) equivocation concerning the folk psychological concepts of conscious experiences. In our present argumentation, at first, we shortly recapitulate our earlier argumentation and Bács’s main objection to it. After that, we argue against the case of equivocation, claiming that it rests on a highly implausible and unsupported verificationist approach. Lastly, in answering another remark of Bács’s, we discuss the possibility of a realist mental fic-tionalism and conclude that it is an incoherent standpoint. (shrink)

Based partly on proving that algebraic relativistic quantum field theory (ARQFT) is a stochastic Einstein local (SEL) theory in the sense of SEL which was introduced by Hellman (1982b) and which is adapted in this paper to ARQFT, the recently proved maximal and typical violation of Bell's inequalities in ARQFT (Summers and Werner 1987a-c) is interpreted in this paper as showing that Bell's inequalities are, in a sense, irrelevant for the problem of Einstein local stochastic hidden variables, especially if this (...) problem is raised in connection with ARQFT. This leads to the question of how to formulate the problem of local hidden variables in ARQFT. By giving a precise definition of hidden-variable theory within the operator algebraic framework of quantum mechanics, it will be argued that the aim of hidden-variable investigations is to determine those classes of quantum theories whose elements represent a statistical content that cannot be reduced in a given way. In some particular way to be stated, a proposition will be stated which distinguishes quantum field theories whose statistical content cannot be reduced without violating some relativistic locality principle. Arguments from fairness as described in Aristotle’s _Rhetoric_ are usually taken to aim at mitigating the strictness of the law or, in terms of procedure, to favour the defendant. This paper considers a more inclusive interpretation, that is, that arguments from fairness can work both ways. In the example given in the _Rhetoric,_ arguments from fairness are directed at a restrictive interpretation of the text. That may not be necessary however. Likewise, fairness may speak for the claimant. Two examples may (...) support this conclusion: a judicial speech by Hyperides, and the doctrine of issues appearing in Hellenistic school rhetoric. The Bayes Blind Spot of a Bayesian Agent is, by definition, the set of probability measures on a Boolean σ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\sigma $$\end{document}-algebra that are absolutely continuous with respect to the background probability measure of a Bayesian Agent on the algebra and which the Bayesian Agent cannot learn by a single conditionalization no matter what evidence he has about the elements in the Boolean σ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\sigma (...) $$\end{document}-algebra. It is shown that if the Boolean algebra is finite, then the Bayes Blind Spot is a very large set: it has the same cardinality as the set of all probability measures ; it has the same measure as the measure of the set of all probability measures ; and is a “fat” set in topological sense in the set of all probability measures taken with its natural topology. Features of the Bayes Blind Spot are determined from the perspective of repeated Bayesian learning when the Boolean algebra is finite. Open problems about the Bayes Blind Spot are formulated in probability spaces with infinite Boolean σ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\sigma $$\end{document}-algebras. Because of the complex interdependence of physics and mathematics their relation is not free of tensions. The paper looks at how the tension has been perceived and articulated by some physicists, mathematicians and mathematical physicists. Some sources of the tension are identified and it is claimed that the tension is both natural and fruitful for both physics and mathematics. An attempt is made to explain why mathematical precision is typically not welcome in physics.

Let be a finite collection of finite algebras of finite signature such that SP( ) has meet semi-distributive congruence lattices. We prove that there exists a finite collection 1 of finite algebras of the same signature, , such that SP( 1) is finitely axiomatizable.We show also that if , then SP( 1) is finitely axiomatizable. We offer new proofs of two important finite basis theorems of D. Pigozzi and R. Willard. Our actual results are somewhat more general than this abstract (...) indicates. (shrink)

The common cause principle says that every correlation is either due to a direct causal effect linking the correlated entities or is brought about by a third factor, a so-called common cause. The principle is of central importance in the philosophy of science, especially in causal explanation, causal modeling and in the foundations of quantum physics. Written for philosophers of science, physicists and statisticians, this book contributes to the debate over the validity of the common cause principle, by proving results (...) that bring to the surface the nature of explanation by common causes. It provides a technical and mathematically rigorous examination of the notion of common cause, providing an analysis not only in terms of classical probability measure spaces, which is typical in the available literature, but in quantum probability theory as well. The authors provide numerous open problems to further the debate and encourage future research in this field. (shrink)

Mutually beneficial exchanges in markets can be exploitative because one party takes advantage of an underlying injustice. For instance, employers of sweatshop workers are often accused of exploiting the desperate conditions of their employees, although the latter accept the terms of their employment voluntarily. A weakness of this account of exploitation is its tendency for over-inclusiveness. Certainly, given the prevalence of global and domestic socioeconomic inequalities, not all exchanges that take place against background injustices should be considered exploitative. This paper (...) offers a framework to identify exploitation in mutually beneficial exchange, focusing on the case of sweatshop labor. It argues that an employer can be viewed as taking unfair advantage of an underlying injustice if and only if the employer’s surplus from the exchange in the unjust state of affairs exceeds the surplus it could maximally obtain in a just state of affairs. The paper illustrates the applicability of this framework using three different conceptions of justice and argues that it is superior to microlevel accounts of exploitation that regard background justice as irrelevant. The paper concludes by describing some normative implications that follow from judging an exchange exploitative. (shrink)

This article shows that we can identify a subset of religious and cultural accommodation cases that follow the structure of a particular disability model: the Human Variation Model. According to this model, disadvantageous disability arises because most social arrangements are tailored to the needs of individuals with typical characteristics; people with atypical features are frequently left out from these arrangements. Hence, the latter need personalised resources tailored to them, or their social and/or material environment ought to change according to their (...) atypical characteristics. I argue, however, that not everyone's claim stemming from an atypical characteristic merits accommodation – it would be simply unreasonable to provide personalised resources to everyone or modify the environment to accommodate everyone's needs. In other words, these human variation claimants must be ‘reasonably accommodated’. Nevertheless, members of certain social groups have a justifiable claim to receive such accommodation and those in religious and cultural groups could be among them for two specific sociological reasons.
